Who Is Liable for a Dog Bite Incidents?

Florida is a “strict liability” state for dog bite injuries. This means, if you are bitten or harmed by someone else’s dog in Florida, even if the owner had no prior knowledge or warning that the dog might bite, you could file a personal injury lawsuit against the owner, as long as the case falls within the two-year statute of limitations (Four-year statute of limitations if the injury occurred prior to March 24, 2023), starting from the date of the injury.
The dog bite statute in Florida (Fla. Statutes section 767.04) says that a dog’s owner is liable for any injuries if the dog bites another person and that person is in a public place or lawfully in a private place (including the property of the owner of the dog).
The dog owner “is liable for damages suffered by persons bitten, regardless of the former viciousness of the dog or the owners’ knowledge of such viciousness.”
The statute only covers dog bites. However, if a person is injured by a dog in another way (e.g., a big dog jumps on you and knocks you down at a park), you may be able to sue the owner for negligence and failing to use reasonable care in controlling the dog that resulted in an injury.
