Dog Bite Attorneys in Texas

Nobody loves dogs more than the RTRLAW team! We’re a pet-friendly firm and love seeing and playing with our attorneys’ and staff members’ fur babies. To us, pets are family members.
However, sometimes animals, in particular, dogs, can turn vicious or attack a person without warning. Children are at the highest risk of being bitten by dogs (boys more than girls), and unrestrained dogs outside an owner’s property and off-leash account for one-third of all dog bites.
What to Do If Bitten by Another Person’s Dog
If another person’s aggressive or vicious dog bites you or your loved one, RTRLAW is there for you.
Dog bites can be quite painful and result in infections, serious injury or even death. If another person’s dog attacks you resulting in an injury, you have recourse to sue for compensation and damages.
Many states have strict liability statutes on injuries caused by dog bites. However, in Texas, there is no such statute. Texas follows the “one bite rule” and common-law negligence liability rules for dog bites. To claim an injury in Texas, you will need to prove that the dog’s owner knew that the dog had bitten someone in the past, or that the owner was careless and negligent in controlling the dog.
In Texas, negligence must be the proximate cause of your injuries for dog bite cases. To prove negligence, you must prove all of the following or your case will be dismissed in court:
- The defendant owned or cared for the dog;
- The defendant had a duty to exercise reasonable care in preventing the dog from injuring others;
- The defendant breached this duty; and
- The breach of duty proximately caused your injuries.
