To claim an injury in Texas, you will need to prove that the dog’s owner knew that the dog had bitten someone in the past, or that the owner was careless and negligent in controlling the dog.
In Texas, negligence must be the proximate cause of your injuries for dog bite cases. To prove negligence, you must prove all of the following or your case will be dismissed in court:
- The defendant owned or cared for the dog;
- The defendant had a duty to exercise reasonable care in preventing the dog from injuring others;
- The defendant breached this duty; and
- The breach of duty proximately caused your injuries.
