Requesting Post-Divorce Modifications
In Florida, a judge has the authority to force one spouse to pay the other spouse a certain amount for both child and spousal support as part of the divorce settlement. Typically, once a judge issues this order, the spouse paying the alimony or child support can’t negotiate the support order. However, the paying party may be able to request a post-divorce modification of the order if his or her financial situation changes substantially.
Both alimony and child support are meant to maintain the lower-earning spouse’s and/or child’s standard of living prior to the divorce, including the home environment and lifestyle of the family. Courts in Florida agree that divorce should not alter or affect a child’s standard of living.
That’s why, in many cases when the lower-earning spouse is awarded primary custody, the court will make the higher-earning spouse pay child support to help maintain the child’s standard of living after the divorce. Spousal support may also be in order if one spouse earns substantially less than the other. When deciding on child or spousal support, a court will review both spouses’ incomes, expenses, previous standards of living, childcare requirements, the length of the marriage and more.
