If your employer has failed to pay you what you are owed, including not meeting minimum wage requirements or intentionally miscategorizing you so that you’re paid less than you’re owed, you may be entitled to recover your withheld wages.
In addition, if you’re not paid for all of the services and time you’ve provided to your company, if you have a dispute regarding paid time off or benefits, or if your business expenses and commissions are not properly reimbursed, you do have rights and can take steps to recover the amount owed to you.
The first step is to contact your employer and/or human resources department at your company and try to resolve the matter directly. It may have just been an oversight, an administrative mistake, or a banking error that is easily rectified. One late paycheck does not normally justify legal action.
However, if you do not receive a few or more regular paychecks, be sure to keep track of the hours you’ve worked and the amount that you should have been paid. If necessary, make sure you are submitting any paperwork required by your company (such as a timesheet or reimbursement form) to get paid. And be sure to contact RTRLAW for advice and assistance.
Florida has its own wage and hour laws, similar to the federal Fair Labor Standards Act (FLSA) requiring employers to pay employees for all hours worked at regular intervals, such as biweekly or monthly. If employers don’t comply with the employment laws, they may receive penalties and fines.
In addition, Florida law requires employers to pay employees at least the minimum wage in the state for all hours worked. Currently, the minimum wage in Florida is $10 per hour (tipped employees must be paid a direct hourly wage of $6.98 per hour). If you are not being paid at least the minimum wage, you can bring a civil action against the employer, such as taking them to small claims court depending on the amount owed to you.
If your employer continuously fails to pay you or you’ve been the victim of wage theft, unlawful deductions, shorted hours or more, you do have certain rights and can bring legal action to sue for what is owed to you.
