We ended up suing the facility and a third party cleaning company they used. The claim was originally denied pre-suit, but after lengthy depositions and discovery, the Defendant ultimately chose to resolve the case.

RTRLAW obtained a settlement of policy limits of $100,000 for the family of a man who crossed an exit of I-595, on foot, wearing dark clothing, at night and while raining. Although it appeared that the man, a pedestrian, would be found mostly at fault, a recorded interview of the driver of the car was obtained from the police, wherein he admitted to not seeing anybody and didn’t even realize he struck a person until he looked back, after the collision. Florida is a comparative negligent state, meaning even if the man was found to be 90% at fault and the driver 10%, due to catastrophic injuries leading to death, RTRLAW was able to pressure the driver’s insurance company to surrender the policy limit.
